OOFOS Gift Card Terms and Conditions
1. Acceptance and Agreement
By purchasing, accepting, or using an OOFOS Gift Card (“Gift Card”), you agree to these Terms and Conditions (“Gift Card Terms”), as well as the OOFOS Terms and Conditions and Privacy Policy. These Gift Card Terms and Conditions constitute a contractual agreement between you and OOFOS, Inc. (“OOFOS”), a Delaware corporation. If you do not agree, do not purchase or use the Gift Card.
2. Purchasing and Redemption
- Gift Cards may be purchased in variable amounts, subject to a daily maximum purchase limit of $1,000.
- Gift Cards may only be purchased and redeemed by persons residing in the United States, its territories, or military posts.
- Redemption is available through the OOFOS.com website or at OOFOS-owned retail locations for eligible products and services. The method of redemption may change at OOFOS’s sole discretion.
- If your order exceeds the Gift Card balance, the remaining amount must be paid with another accepted payment method.
- You do not need an OOFOS account to purchase a Gift Card, but an account is required to redeem the balance. Personal information that you provide in connection with the purchase or redemption of Gift Cards will be governed by the OOFOS Privacy Policy.
3. Balance Inquiry
- For balance inquiries, contact info@oofos.com. Balance information provided is an estimate and may be subject to delay in updates.
4. Expiration and Fees
- No fees apply to Gift Cards.
- Gift Cards never expire.
5. Use and Limitations
- Gift Cards are not reloadable.
- Gift Cards cannot be redeemed for other Gift Cards, transferred to other accounts once redeemed, or used for unauthorized advertising, marketing, sweepstakes, promotional, or commercial purposes.
- Gift Cards are not returnable or refundable for cash except as required by law.
- Coupons and discounts cannot be applied to Gift Card purchases. If other merchandise is included in your order, coupon value applies only to those items.
- Sales tax will not be applied to Gift Card purchases; tax applies only to other merchandise in your order.
- Gift Cards may not be used for purchases outside the United States or its territories.
6. Risk of Loss
- Title and risk of loss for Gift Cards pass to the purchaser upon electronic transmission, delivery to the carrier, or at the time of in-person purchase.
- OOFOS is not responsible for lost, stolen, destroyed, or unauthorized use of Gift Cards. In limited circumstances, OOFOS may elect to replace the remaining value at its discretion.
7. Fraud
- OOFOS reserves the right to void Gift Cards, close accounts, and bill alternative forms of payment if a Gift Card is obtained, used, or applied fraudulently, unlawfully, or in violation of these Gift Card Terms.
8. Limitation of Liability
- GIFT CARDS ARE PROVIDED “AS IS.” OOFOS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING GIFT CARDS, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TO THE FULLEST EXTENT PERMITTED BY LAW, OOFOS AND ITS VENDORS SHALL NOT BE LIABLE FOR ANY DIRECT OR INDIRECT LOSS, DAMAGE, INJURY, CLAIM, OR LIABILITY RESULTING FROM THE GIFT CARDS OR THEIR USE. YOUR SOLE REMEDY IS RECOVERY OF THE LAST BALANCE HELD ON YOUR GIFT CARD.
- In the event a Gift Card that has not been fully redeemed is non-functional, OOFOS’s sole liability is replacement of the Gift Card.
9. Dispute Resolution
- Any dispute involving Gift Cards will be governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law provisions.
- All disputes, claims, and legal proceedings shall be resolved individually, without resort to class action, and exclusively in the state or federal courts of Boston, Massachusetts. You waive all defenses of “lack of personal jurisdiction” and “inconvenient forum” with respect to venue and jurisdiction.
10. Changes to Terms
- OOFOS reserves the right to modify these Gift Card Terms at any time without notice, to the extent permitted by law. If any term is deemed invalid or unenforceable, it will not affect the validity of the remaining terms.
